1. Introduction

Welcome to Capital Cabs. We operate as a rideshare service and same day parcel delivery service in Canberra, ACT. By accessing or using our services whether as a driver, rider or parcel customer, you agree to be bound by these Terms and Conditions (ā€œTermsā€).
These Terms comply with Australian Consumer Law (ACL), Fair Trading (Australian Capital Territory) Act 1992, and other relevant ACT transport regulations.

3. General Service Terms

  1. We operate 24/7 with local customer support.

  2. All bookings must be made via our mobile application.

  3. We reserve the right to refuse service if safety concerns arise or if Terms are breached.

  4. We are committed to fair pricing, ethical driver treatment and on ground dispute resolution.

4. Payment Terms (General)

  1. Upfront Payment Required: All rides and parcel deliveries must be paid in full before the service commences.

  2. Payment methods:

    • Via the Square App (card, mobile wallet, online payment)

    • Cash (subject to driver’s available float)

  3. If paying in cash, exact change is preferred.

  4. Drivers are not allowed to commence service unless payment has been processed.

  5. Payments are non-refundable once the trip/delivery has commenced, except as required under Australian Consumer Law.

5. Driver Terms

  1. Commission: All fares include a 20% commission payable to Capital Cabs.

  2. Payment Handling:

    • Drivers must always charge the ride upfront using the Square App provided.

    • It is the driver’s responsibility to ensure the Square App is working before starting their shift.

    • Drivers must maintain a decent float of cash to accommodate cash paying riders.

  3. Square App Transaction Protocol:

    • Only proceed with the trip after the Square App shows ā€œApproved Transactionā€.

    • If the rider requests a receipt, add their phone number into the Square App to send it electronically.

    • If no receipt is requested, press ā€œNo Receiptā€ on the Square App.

  4. Driver-Rider Communication:

    • Drivers may only contact riders before or during a trip to confirm pickup or arrival.

    • If a previous rider contacts you after a trip, you must notify Capital Cabs immediately.

    • Unauthorised personal contact with riders is strictly prohibited.

  5. Ride Refusal: Drivers have the right to refuse a ride if there are reasonable safety concerns.

  6. Compliance: Drivers must comply with all ACT rideshare laws, safety standards and vehicle inspection requirements.

6. Rider Terms

  1. Upfront Payment Requirement:

    • Riders must pay in full upon entering the vehicle according to the payment method selected in the app.

    • Drivers are bound not to provide service unless payment is received upfront.

  2. Behaviour: Riders must:

    • Treat drivers and vehicles with respect.

    • Avoid abusive, threatening, or unsafe behaviour.

  3. Cancellations:

    • Trips cancelled after payment but before commencement may be refunded at Capital Cabs’ discretion, minus applicable fees.

  4. Lost Property: Riders are responsible for collecting lost property from our office or coordinating with our support team. Or we can arrange a drop off of lost property if found at rider's cost.

7. Parcel Delivery Terms

  1. All parcel deliveries must be paid upfront.

  2. Capital Cabs is not liable for:

    • Incorrect delivery addresses provided by the customer.

    • Parcels not packaged securely by the sender.

  3. High-value or fragile items must be declared before booking.

  4. Same day delivery applies within Canberra only, subject to availability.

    Prohibited Items (Parcel Delivery)

    You must not send:

    • Hazardous materials or dangerous goods (flammables, explosives, corrosives).

    • Illegal drugs, weapons, or stolen property.

    • Live animals.

    • Perishable goods that require temperature control.

    • Any item prohibited under ACT or Australian law.

8. Safety & Dispute Resolution

  1. All disputes will be handled fairly with both sides heard.

  2. Drivers and riders are encouraged to report safety concerns immediately.

  3. We maintain on-ground dispute resolution and will not unfairly block driver accounts without proper investigation.

9. Privacy

We collect and store personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). For full details, refer to our Privacy Policy.

10. Limitation of Liability

  1. Independent Contractors
    Capital Cabs engages drivers as independent contractors. Accordingly, Capital Cabs does not directly control or employ drivers and is not liable for any acts, omissions or negligence of drivers beyond what is required by law.

  2. Service Provided ā€˜As Is’
    Capital Cabs provides the rideshare and parcel delivery services on an ā€œas isā€ and ā€œas availableā€ basis. While we strive to provide reliable and safe services, we make no guarantees regarding availability, timeliness or the condition of services provided by drivers.

  3. Extent of Liability
    To the fullest extent permitted by law, Capital Cabs excludes all liability for any:

    Where liability cannot be excluded by law, Capital Cabs total liability for any claim arising out of or in connection with the services is limited to the amount paid by the customer for the relevant ride or parcel delivery.

    Users (riders and parcel customers) acknowledge and accept that:
